Budget hearing

A budget hearing for the inhabitants of the Livingston Manor Central School District qualified to vote at School District meetings will be held at the Old Gymnasium/Auditorium of the Livingston Manor Central School District, 19 School Street, Livingston Manor, New York, commencing at 6:00 p.m. on Tuesday, May 2, 2023 where there shall be presented the proposed school district budget for the following school year, July 1, 2023 – June 30, 2024.

Date of Vote

The vote upon the appropriation of the necessary funds to meet the estimated expenditures or for any propositions involving the expenditure of money or the authorizing of levy of taxes, as well as the election of members of the Board of Education shall be held on Tuesday, May 16, 2023 at the New Gymnasium of the Livingston Manor Central School, 19 School Street, Livingston Manor, New York between the hours of 10:00 a.m. and 8:00 p.m.

Statement of Money Required for Next School Year

Proposition No. 1:

Shall the following resolution be approved:

RESOLVED, that the Board of Education of the Livingston Manor Central School District, be authorized to make the expenditures shown in the budget presented by the Board of Education for the 2023-2024 school year and to levy the necessary tax therefore.

NOTICE IS HEREBY FURTHER GIVEN that at said Annual School District Meeting and Election to be held on May 16, 2023, the following propositions will be submitted:

Proposition No. 2:

IMPROVEMENTS TO SCHOOL DISTRICT BUILDING AND FACILITIES

Shall the following resolution be adopted, to‑wit:

RESOLVED, that the Board of Education of the Livingston Manor Central School District, Delaware, Sullivan and Ulster Counties, New York, is hereby authorized to construct an addition and improvements to the School District building and related facilities, including original furnishings, equipment, machinery, apparatus, appurtenances, site work and other incidental improvements and expenses in connection therewith, at a maximum estimated cost not to exceed $21,000,000, and that $5,000,000 of 2005 Capital Reserve Fund monies and $4,000,000 of available fund balance shall be used to pay a portion thereof, and that the remaining $12,000,000 of said amount, or so much thereof as may be necessary, shall be raised by the levy of a tax upon the taxable property of said School District and collected in annual installments as provided by Section 416 of the Education Law; and, in anticipation of such tax, obligations of said School District shall be issued.

Proposition No. 3

RECONSTRUCTION OF FLOOD WALLS AND WALK BRIDGE

Assuming that Proposition No. 2 is approved, shall the following resolution be adopted, to‑wit:

 RESOLVED, that the Board of Education of the Livingston Manor Central School District, Delaware, Sullivan and Ulster Counties, New York, is hereby authorized to reconstruct flood walls and the walk bridge at the School District campus, including incidental improvements and expenses, in connection therewith , at a maximum estimated cost not to exceed $7,000,000 and that said amount, or so much thereof as may be necessary, shall be raised by the levy of a tax upon the taxable property of said School District and collected in annual installments as provided by Section 416 of the Education Law; and, in anticipation of such tax, obligations of said School District shall be issued.

 The School District has determined that the capital improvements projects are each a “Type II Action” pursuant to 6 NYCRR Part 617.5(c)(1), (2) and (10) (formerly (8)) of the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, the School District has determined, as such, will not result in any significant adverse environmental impacts.  SEQRA compliance materials are on file in the office of the School District Clerk where they may be inspected during regular office hours upon appointment.

NOTICE IS HEREBY FURTHER GIVEN that at said Annual District Meeting and Election the following proposition will be submitted:

Proposition No. 4

CAPITAL RESERVE FUND PROPOSITION

Shall the following resolution be adopted, to-wit:

RESOLVED, that the Board of Education of the Livingston Manor Central School District, Delaware, Sullivan and Ulster Counties, New York, is hereby authorized to establish a capital reserve fund pursuant to Section 3651 of the Education Law to be designated “Buildings and Facilities Improvement Capital Reserve Fund” in order to defray all or part of the cost of the construction of improvements to, additions to, and reconstruction of School District buildings and facilities, including original equipment, machinery, apparatus, appurtenances, site improvements, and other incidental costs and expenses in connection therewith, and, in order to accomplish the same, said Board is hereby authorized to establish the ultimate amount of such Reserve Fund to be $10,000,000 plus accrued interest with a probable term of ten years and, to appropriate annually from available fund balance and/or other legally available funds of the School District to such Reserve Fund together with the unexpended balance of the existing 2005 Capital Reserve Fund, if any, remaining after expenditure for the capital project in Proposition 1 if authorized by the voters at this Annual District Meeting and Election.

Vote for Board Members

Petitions nominating candidates for the office of School Board Member must be filed with the Clerk of the District during prevailing hours, and no later than 5:00 pm on Monday, April 17, 2023.  The following two (2) “at large” vacancies are to be filled for the Board of Education:

Two(2) three (3)-year terms commencing July 1, 2023 and ending June 30, 2026.  These seats are presently held by Mr. Elliott Madison and Mrs. Dawn D’Auria, whose term of office shall expire on June 30, 2023.

Each petition must be addressed to the Clerk of the District, be signed by at least 25 qualified voters of the District, shall state the residence of each signer, and the name and address of the candidate.  Vacancies upon the Board shall not be considered separate specific offices. The individuals receiving the highest number of votes shall be elected to the vacancies.

Additional Propositions

Any proposition that is required to be included for vote shall be submitted in writing by means of a petition signed by at least 25 qualified voters, stating the residence of each signer, which proposition shall be filed with the Board of Education not later than 30 days before the date of the election as set forth in this notice unless a greater number of days is required by statute.  Any proposition shall be rejected by the Board of Education if the purpose of the proposition is not within the powers of the voters or where the expenditure of monies is required for the proposition, and such proposition fails to include the necessary specific appropriation.

Absentee Ballots

Applications for absentee ballots may be obtained at the office of the Clerk of the District.  Such applications must be received by the District Clerk at least seven days before the vote set in this notice if the ballot is to be mailed to the absentee voter or the day before the vote if the ballot is to be delivered personally to the absentee voter.  Absentee ballots must be received in the office of the District Clerk not later than 5:00 pm on the day of the vote. 

Military voters who are qualified voters of the School District may apply for a military ballot by requesting an application from the District Clerk.  For a military voter to be issued a military ballot, the District Clerk must have received a valid ballot application no later than 5:00 pm on April 24, 2023. In a request for a military application or military ballot the military voter may indicate their preference for receiving the application or ballot by mail, facsimile transmission or electronic mail. The School District will transmit military ballots to military voters no later than April 21, 2023, which is twenty-five (25) days prior to the vote. Completed military ballots must be received in the office of the District Clerk of the District not later than 5:00 p.m. on May 16, 2023 (the day of the vote) in order to be counted.

Pursuant to the provisions of Section 2018-a of the Education Law, qualified voters who meet the criteria for “permanently disabled” and are so certified by the Sullivan County Board of Elections,  Delaware County Board of Elections or Ulster County Board of Elections will receive paper ballots by mail.

A list of all persons to whom absentee voters’ ballots have been issued will be available for public inspection in the District Clerk’s Office during each of the five days prior to the date of the Annual Meeting and Election, weekdays between the hours of 8:30 a.m. and 3:30 p.m.  Such list will also be posted at the polling place at the Annual Meeting and Election of Members of the Board of Education.

Registration of Voters

Personal registration of voters is required for the annual vote, and no person shall be entitled to vote thereat whose name does not appear in the register of the school district, except those persons who registered to vote pursuant to the provisions of Election Law § 5-612.  Persons otherwise qualified to vote who voted in any annual vote conducted within four calendar years before the preparation of the register need not personally register for this vote.  Personal Registration may be achieved on any day, Monday through Friday, from 8:30 am to 3:30 pm at the Main Office of the Livingston Manor Central School, 19 School Street, Livingston Manor NY up until Thursday, May 11, 2023.   Members of the Board of Registration shall meet at the District Office, Livingston Manor Central School on May 11, 2023, between the hours of 9:00 a.m. and 1:00 p.m. to prepare the register of the school district. Any person shall be entitled to have his or her name placed upon such register in the district in which that person resides, provided that in such meeting of the Board of Registration that person is known or proven to the satisfaction of such members to be then and thereafter entitled to vote at the annual vote for which the registration is prepared.  Any person 18 years of age or over, a citizen of the United States, and a resident of the school district for 30 days next preceding the date for voting is entitled to register and vote. The register of the school district so prepared shall be filed five days before the date of the vote in the office of the District Clerk, located in the District Office where it shall be open for inspection by any qualified voter of the District between the hours of 8:30 a.m. to 3:30 p.m. each day up to and including the day set for the vote, including Saturday by advance appointment, and excluding Sunday.
